Terms and Conditions of Auction Participation

 

 

1. This is a Live and Absentee Auction. The Live Auction will be held at our office in Reno, NV on Tuesday, April, 21, 2009, starting at 6:00 pm PST.

2. Absentee Bidding. Absentee Bids will be accepted until 5pm the day of the auction. You may bid on items in the sale by mail, email, online, by fax or by phone, through an agent or show up and bid. If you do not already have a permanent bidder number, you will receive a bidder number after registering. Absentee bids accepted as outlined above. After that time only live bids from the floor or pre-arranged telephone calls during the live auction will be accepted. It is your responsibility to get absentee bids in early so we receive them by the required due date. It is your responsibility to submit all lot numbers and bid amounts accurately. Absentee bids should be equal to at least 60% of the low estimate if an estimate is provided. Bids placed below 60% of the low estimate may be considered inappropriate and may not be entered. Alternately we may choose to open lots at a minimum. It is your responsibility to call us to make sure that we received your bids.

3. Floor Bidding.
Please arrive a few minutes early to check in and receive your bidding paddle. We will open lots with more than one bid at the current high absentee bid or 60% of the low estimate at the auctioneer.s discretion. Please be sure to bid on the correct lots during the live auction. Our auctions progress at a rate of between 150 and 240 lots per hour. When the auctioneer says .sold., he will identify the successful bidder by number and announce the winning bid amount. If you are not sure whether you won the lot or not, it is your responsibility to ask for clarification immediately. Tie bids are awarded to the first absentee bid placed if not advanced on the floor, or by a phone or live internet bidder.

4. Telephone Bidding. Telephone bidding requests MUST be scheduled prior to this auction.

If you do not schedule in advance, and choose instead to call on the day of the auction to request a line for bidding, you may find that we are unable to accommodate your request. Please limit your telephone bids to items of value greater than $100, or a string of items with a similar total.

5. Live Internet Bidding. Live bidding is not available at this time. Internet bidding will close at 5:00pm on the day of the auction.

6. Mail Bidding. We will accept bids by mail until the day of the auction. It is your responsibility to verify that we received your bid.

7. Bid Reduction. All winning absentee bids will be reduced to the next bidding increment, unless the bid is at 60% of the low estimate. For example, if you submit an absentee bid of $1000 on a lot estimated at $200, and the next highest bid is $250, then you will win the lot for $275.

8. Bid Increments. Absentee bids must be submitted in the appropriate increments as outlined below. IF you choose to submit bids in an increment not listed below, your bid will be rounded either up or down to the nearest increment and you will be expected to pay the amount to which the bid was rounded should your bid be the winning bid. If you have any questions about an appropriate bid amount, please call us.

9. Bid Information. Collectors often ask in advance the price level of a particular lot. We will give out the current high absentee bid until 5pm on the day of the auction. You may also view absentee bids online at www.holabirdamericana.com. If you missed our bidding deadline, you may ask if you can still submit bids without bidder information. Our client list and all under bidder information is proprietary information. Please do not request this information.

10. Bid Cancellation. If you wish to cancel a bid after you have submitted your bids to us. You MUST PHONE us to advise us of this. Bid cancellations through mail, email or fax are not advisable.

10A. No Lot or Withdrawn Lot. Bids on "No Lots" or "Withdrawn" lots are considered no bids.

11. Buyers Premium. There will be a 15% buyer.s premium added to each lot.

12. Point of Origin of Sale: All sales originate in Reno, Nevada and are subject to all legal sales tax requirements.

13. Payment & Lot Pick Up. Payment is due in full within 15 days of receipt of invoice. Payment can be made to Holabird-Kagin Americana, 3555 Airway Dr., #308, Reno, NV 89511. Payment is accepted in cash, US funds or checks drawn on US banks . All returned checks are subject to a $25 fee. Lot pick up will be available no sooner than the next business day following the auction.

14. Shipping. We do not ship any purchases until we receive payment in full. If you choose not to pick up your lot in person you will assume all shipping and handling fees that apply to your purchase. An invoice will be sent to you as soon as auction results have been processed. Upon payment of the invoice, your package will be sent to you. In some circumstances, we MAY approve shipment of purchases with an invoice, but this must be arranged well in advance of the sale and will be based on client history with our company, approval of the consignor(s), and credit references furnished by the buyer. We retain the right to deny this request for any reason. A $5 Handling Charge will be billed on all shipments. Some shipments may require special handling, for which individual costs will be calculated. All applicable shipping and handling charges will be added to your purchase amount and included on your invoice. All purchases will be shipped upon payment of the total amount due on the invoice, via our approved, insured carriers, Federal Express or the US Postal Service. All items shipped will be insured for the full value determined at auction by Holabird-Kagin Americana at no extra cost to the buyer. The buyer is only responsible for shipping and handling fees as described above. If the buyer assumes responsibility for any losses or damages that may occur during shipping and waives our insurance coverage, they may request a different method of shipping for their item.

15. Results. Please do not contact our office until the next business day after the auction closes to request results. Results are also available free online. To request a printed version, please contact the office.

16. Return Policy. You may return any piece that was significantly inaccurately described within one week of receipt of item(s). We do not refund postage or insurance. We have attempted to describe condition accurately. If no condition is given, assume average. When we receive your bids we will assume you have read the description in the catalog and have contacted us regarding any questions you may have on any lot. Please call us if you require a more specific condition report.

17. Preview. Lots will be available to preview at the Ogden Coin Show located inside the Ogden Marriott Hotel, 247-24th Street, April 10-12th. Lots will also be available to preview at our office in Reno beginning Monday April 20th up until 5pm April 21st, earlier preview will be available by appointment.
